Background

  1. The resident is a tenant of the landlord’s. She lives in a 2-bedroom house with her son. She has vulnerabilities which include mobility issues and a chronic lung condition. Her complaint largely relates to damp and mould issues linked to the property’s drains. She complained to the landlord around August 2025. She subsequently raised a legal disrepair claim. Among other issues, her claim cited long-term damp, mould, and drainage problems.

Our decision (determination)

  1. After considering the evidence, we have found that the complaint is outside of our jurisdiction. As a result, we have not investigated it.

Reasons

  1. We cannot investigate issues which are also subject to legal proceedings or where matters at court are connected so closely to the complaint, they cannot be separated. In this case, we can see legal proceedings were issued at court on 25 February 2026. We can also see that the matters at court include alleged damp, mould, and drainage issues over a prolonged period.
  2. From the information seen, we are satisfied that the subject matter of the resident’s complaint is the same as, or closely connected to, her legal claim with the court. That means we have no power to investigate the complaint.
