Background
- The resident has an assured tenancy with the landlord. He lives in a flat. He complained about various repair issues soon after he moved in. He subsequently made a legal disrepair claim. The resident has vulnerabilities relating to his physical and mental health. These include a heart condition and attention deficit hyperactivity disorder (ADHD).

- The complaint is about the landlord’s response to the resident’s reports and concerns about various repair issues.
Our decision
- We have not investigated the resident’s complaint because it is outside of our jurisdiction.
Reasons
- The landlord has supplied evidence that shows a court ‘struck out’ (dismissed) the resident’s legal claim because he did not provide it with supporting information. We may not consider complaints which concern matters where a resident has or had the opportunity to raise their complaint/concerns as part of legal proceedings.
- In this case, we are satisfied that the resident had an opportunity to raise his concerns with a court. He may be able to challenge the court’s previous decision. If the resident wants to pursue the matter with the court, we encourage him to seek legal advice. Citizens Advice has a website that includes information about the legal process.
