Background
- The resident lives in a 1-bedroom flat. He has vulnerabilities that are known to the landlord. In February 2024, the landlord was notified of an incident of antisocial behaviour (ASB) involving the resident and his neighbour.
What the complaint is about
- The complaint is about the landlord’s handling of reports of ASB made against the resident.
Our decision (determination)
- We have found that this complaint is not one we can consider and is outside of our jurisdiction to investigate.
Reasons
- We cannot investigate issues that have already been determined by a court where a judgement on the merits was given, or where the matters before the court were so closely connected to the complaint that they cannot reasonably be separated.
- In this case, the landlord sought an injunction against the resident due to incidents of ASB. On 23 April 2024, the court granted an interim injunction. The evidence indicates that the resident did not contest the injunction at a subsequent hearing, and it remained in effect until April 2025. As the court has issued a decision in which the resident had the opportunity to participate, we have no power to investigate the complaint.
