Background
- The resident’s lease started on 31 March 2020. The property was a new build and the development was still being finished when the resident moved in. There was an area of communal land that was not finalised and remained fenced off to residents. The landlord’s complaint responses of 17 October 2023 and 15 February 2024 confirmed it could not resolve the issue until a legal matter was concluded.

Our decision (determination)
- We have not investigated the resident’s complaint because it is outside our jurisdiction.
Reasons
- We cannot investigate complaints which concern matters that are the subject of court proceedings or were the subject of court proceedings where judgement on the merits was given.
- The landlord’s solicitors wrote to us on 20 August 2024 to confirm that it was engaged in court proceedings with the adjacent landowner. On 10 March 2026 the landlord emailed us to confirm that court proceedings were ongoing.
