Our decision (determination)
- The complaint is outside the jurisdiction of our service and therefore was not investigated.
Reasons
- We cannot investigate a complaint unless it was brought to us by one of the people eligible to complain. A person is eligible to complain to us if they have (or had) a lease tenancy or licence with the landlord, or applied for one. Alternatively, a person who is authorised to bring a complaint on behalf of a leaseholder, tenant or licensee is eligible to bring a complaint to us.
- The resident owns the freehold for her house and therefore was not in a landlord and tenant relationship. We subsequently do not have the jurisdiction to investigate her complaint and make a determination.
