Background

  1. On 16 November 2023 the landlord wrote to the occupiers of properties local to 3 sites where it was due to start development works. This letter advised works were due to start soon and that the building contractor would write to affected residents before the works began. The resident lives nearby one of the development sites.
  2. On or around 27 November 2023 the resident complained to the landlord. They said the contractor had started works without contacting them. They were also unhappy about the level of noise being made during demolition works.

What the complaint is about

  1. The complaint is about the landlord’s handling of the resident’s concerns about its nearby building development.

Our decision (determination)

  1. We have found the complaint is outside our jurisdiction and we have not investigated it.

Reasons

  1. The landlord is a council. We can only investigate complaints about councils where they are acting as the landlord under a licence, lease, or a social housing tenancy. In this case, the council was not acting in its role as a landlord. The matter being complained about was in connection with the development of new buildings on council owned land. This was in line with its Housing Delivery Plan.
  2. The landlord, acting in its role as the council, confirmed to the resident that it had sent a letter on 16 November 2023 to all households which were local to the development sites. This included properties which were not owned by the council or occupied by council tenants. It also confirmed that any further communications, either from it or the building contractor, would also be sent to all affected households.
  3. We have decided the complaint does not concern matters in respect to the landlord’s provision or management of the resident’s home. As such, we have no power to investigate the complaint about its handling of the resident’s concerns about its nearby building development. The resident may be able to complain to the Local Government and Social Care Ombudsman.
