Background
- The resident complained to the landlord that its actions in response to his CCTV cameras were unreasonable. He said that as well as telling him to remove the cameras, the landlord had harassed him by visiting his property on several occasions and taking pictures. The landlord responded to the complaint and said it had attempted to enforce its policies and the resident’s tenancy agreement.
What the complaint is about
- The resident’s complaint is about the landlord’s actions around CCTV cameras at his property.
Our decision (determination)
- We found that the resident’s complaint is outside our jurisdiction to investigate.
Summary of reasons
- We cannot investigate issues that are also subject to legal proceedings, or where matters at court are connected so closely to the complaint, they cannot be separated.
- Both the resident and landlord told us that there are ongoing court proceedings relating to the resident’s use of CCTV cameras and the landlord’s actions in attempting to have them removed. The landlord provided evidence to show that a court date has been set for the matter to be considered, meaning both parties will have the opportunity to set out their arguments in a legal setting.
- Given that the matters relating to the complaint are the subject of legal proceedings, we have no power to investigate the complaint.
