Background
- The resident had building work carried out for an extension that was funded by a disabled facilities grant. The resident complained to the landlord when problems arose with the quality of the building work. Some repairs were also identified within the main property which the landlord completed but the resident was not happy with the quality of these.

- The complaint is about the landlord’s response to:
- building work associated with a disabled facilities grant.
- the standard of the repairs carried out to the main property.
Our decision (determination)
- After considering the evidence, we have found the complaints are outside our jurisdiction. As a result, we have not investigated the resident’s complaints.
Reasons
Building work associated with a disabled facilities grant
- We are not free to investigate every complaint referred to us. Our Scheme rules say we may not investigate complaints which fall properly within the jurisdiction of another Ombudsman, regulator or complaint-handling body.
- The resident’s complaint is about building work carried out under the disabled facilities grant scheme. This means any associated complaint falls within the jurisdiction of the Local Government and Social Care Ombudsman (LGSCO). Therefore, we have no jurisdiction to investigate this. The resident may wish to contact the LGSCO for further assistance with her complaint.
The standard of the repairs carried out to the main property
- The resident has raised complaint issues which have not exhausted the landlord’s complaint procedure. We have no power to investigate complaints which the landlord has not had the chance to put right first. There is no evidence the resident raised the complaint about the standard of the repairs. Therefore, we have no power to investigate.
- As these matters have not been considered by the landlord’s internal complaint procedure, the resident may wish to raise a new complaint with her landlord.
