Background

What the complaint is about
- The complaint is about the landlord’s handling of an agreement to offer alternative accommodation to the resident.
Our decision (determination)
- We have found that this complaint is not one we can consider and is outside of our jurisdiction to investigate.
Reasons
- We cannot investigate a complaint unless it was brought to us by someone who is eligible to complain. A person is eligible to complain to us if they have (or had) a lease, tenancy or licence with the landlord, or applied for one. Alternatively, a person who is authorised to bring a complaint on behalf of a leaseholder, tenant or licensee is eligible to bring a complaint to us.
- In this case, the joint tenancy ended in April 2020, at which point the resident ceased to be a tenant. The matter complained of arose in November 2021, when the landlord allegedly agreed to offer the resident alternative accommodation. At that time, the resident was not in a landlord-tenant relationship and did not have an active housing application with the landlord. That means we have no power to investigate the complaint.
